Declarations and conditions

3.1

The parties acknowledge having read every clause of this form and of the annexes attached to it, which form an integral part of this agreement.

3.2

The conditions of financing and of inspection are described in Annex G and must be satisfied within the delays stated there. Failure to satisfy either renders this agreement null without penalty to either party.

3.3

Any modification to this form must be made in writing and initialled by all parties. Electronic initials and signatures carry the same legal value as handwritten ones.

3.4

The client declares being the sole owner of the immovable, or being duly authorised to bind every co-owner, and that no promise to sell has been granted to a third party.

3.5

The broker undertakes to present every promise to purchase received to the client, and to advise on its terms, without exception.

3.6

The client authorises the broker to publish the immovable on Centris and on any platform the agency uses, and to hold visits by appointment.

Annex G — financing and inspection

4.1

FINANCING. The purchase is conditional on the purchaser obtaining a mortgage loan of at most 80 % of the purchase price, at the rate then current, within fifteen (15) days of acceptance.

4.2

The purchaser undertakes to submit a complete application within five (5) days and to inform the broker of the lender’s decision in writing without delay.

4.3

INSPECTION. The purchase is conditional on an inspection of the immovable by a professional inspector, at the purchaser’s expense, within ten (10) days of acceptance.

4.4

Should the inspection reveal a factor that significantly reduces the value of the immovable or its intended use, the purchaser may withdraw upon delivering the written report.

4.5

The seller undertakes to give the inspector reasonable access to every part of the immovable, including the attic, the basement and any outbuilding.

6.1

The seller declares having no knowledge of any latent defect affecting the immovable, nor of any water infiltration in the basement or through the roof in the last five years.

6.2

The seller declares that the immovable is not situated in a flood zone, a landslide zone or a protected agricultural area.

6.3

The seller declares that the lower unit is leased until 30 June under a written lease, a copy of which is attached, and that the rent is paid to date.

6.4

The seller declares that no work has been carried out without the permits required by the municipality, and that no notice of non-conformity is outstanding.

6.5

The seller declares that the certificate of location dated 2019 reflects the current state of the immovable and that no structure has been added since.
